1. Introduction
These Terms and Conditions (“Terms”) govern your use of the Logan's Flowers website (www.logansflowers.co.za) and any orders you place through it. By using our website or placing an order, you agree to be bound by these Terms.
These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act, 2008 (CPA) and the Electronic Communications and Transactions Act, 2002 (ECT Act).
These Terms must be read together with our Privacy Policy, which explains how we collect, use, and protect your personal information. The Privacy Policy forms part of these Terms.

2. Definitions
- “We”, “us”, “our” — Logan's Flowers
- “You”, “your” — the person placing an order or using our website
- “Order” — a request to purchase and deliver flowers or related products through our website
- “Recipient” — the person to whom flowers are delivered (which may be you or a third party)
3. Placing an Order
3.1. All orders are placed through our website and are subject to availability.
3.2. By placing an order, you confirm that:
- You are at least 18 years old or have parental consent;
- The information you provide is accurate and complete;
- You have the authority to use the payment method provided.
3.3. An order is confirmed only once we have received payment in full via Yoco or PayFast. You will receive an on-screen confirmation with your order number.
3.4. We reserve the right to decline any order at our discretion, in which case a full refund will be issued.
3.5. While we make every effort to match the bouquet shown on the website, flowers are a natural product and may vary slightly in colour, size, and composition depending on seasonal availability. We may substitute individual stems with flowers of equal or greater quality and value.
3.6. Gift Orders
When you place an order for delivery to a third party (the Recipient), you warrant that:
- You have the Recipient's consent (or legal authority) to provide us with their personal information; and
- All details provided about the Recipient are accurate.
Our contract is with you (the person placing the order). The Recipient has no direct contractual rights against us. Any complaints regarding delivery or quality should be directed to us through you.
4. Pricing and Payment
4.1. All prices are displayed in South African Rand (ZAR) and include VAT where applicable.
4.2. We accept payment via Yoco (card payments) and PayFast (card and EFT payments). Payment is processed at the time of ordering.
4.3. We do not store your card details. All payment information is processed securely by Yoco and PayFast in accordance with PCI-DSS standards.
4.4. We reserve the right to update prices at any time. The price applicable to your order is the price displayed at the time you place the order.
5. Delivery
5.1. We deliver to selected suburbs in the Greater Johannesburg metropolitan area. Exact delivery zones and fees are displayed at checkout.
5.2. A minimum of 24 hours' notice is required. Same-day delivery is not available. Delivery must be scheduled within 14 days of placing the order.
5.3. Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by traffic, weather, incorrect addresses, or circumstances beyond our control.
5.4. If no one is available: Our driver will contact the recipient by phone. If there is no response within 15 minutes, the driver will return with the flowers. A redelivery fee equal to the standard delivery fee will apply.
5.5. Risk in the flowers passes to the recipient upon delivery.

6. Cancellations and Cooling-Off Rights
6.1. You may cancel your order up to 24 hours before the scheduled delivery date for a full refund (less any payment processing fees charged by Yoco or PayFast).
6.2. Cancellations less than 24 hours before delivery cannot be accepted, as flowers are perishable and will already have been prepared.
6.3. Under Section 44 of the ECT Act, consumers generally have the right to cancel an online transaction within 7 days. However, because flowers are perishable goods that deteriorate rapidly, this cooling-off right does not apply once delivered (except where flowers arrive damaged or not as described — see Section 7).
6.4. To cancel, email info@logansflowers.co.zawith your order number. Refunds will be processed within 5–10 business days.
Nothing in these Terms limits any rights you may have under the Consumer Protection Act or ECT Act that cannot lawfully be excluded.
7. Returns, Replacements, and Complaints
7.1. Due to the perishable nature of flowers, we do not accept returns.
7.2. If you receive flowers that are damaged, wilted, or significantly different from what you ordered, you must:
- Contact us at info@logansflowers.co.za within 24 hours of delivery
- Provide photographic evidence of the issue
7.3. If your complaint is valid, we will send a replacement arrangement at no additional cost. We do not offer cash refunds for delivered orders, except where required by the Consumer Protection Act.
7.4. Complaints without photographic evidence, or submitted more than 24 hours after delivery, may not be accepted.
7.5. Natural variations in flower colour, size, or bloom stage do not constitute a defect.
8. Your Account
You are responsible for maintaining the confidentiality of your account credentials and are liable for all activity under your account. We reserve the right to suspend accounts used fraudulently.
9. Intellectual Property
All content on our website — including text, images, logos, and design — is the property of Logan's Flowers and is protected by South African copyright law.
10. Limitation of Liability
10.1. To the maximum extent permitted by law, we shall not be liable for indirect, incidental, or consequential damages, losses from delivery delays beyond our control, or damage to flowers after delivery.
10.2. Our total liability for any claim shall not exceed the amount you paid for that order.
10.3. Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Consumer Protection Act 68 of 2008 or any other law that cannot lawfully be excluded or restricted.
11. Force Majeure
We shall not be liable for failure or delay caused by circumstances beyond our reasonable control, including natural disasters, severe weather, power outages, strikes, civil unrest, or supply chain disruptions.
12. Governing Law and Disputes
These Terms are governed by the laws of South Africa. We encourage you to contact us first to resolve disputes informally. If unresolved, disputes shall be subject to the jurisdiction of the courts in Johannesburg. Nothing limits your right to approach the National Consumer Commission.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of our website after changes constitutes acceptance.
